Why the requirement exists
A Special Area of Conservation is protected for its habitats and species. Under the Habitats Regulations assessment process, the competent authority must consider whether a plan or project could adversely affect the site's integrity, including effects in combination with other development. The applicant supplies the information needed for that assessment; the authority makes the assessment and decision. [2]
Epping Forest District Council identifies increased recreational use and air pollution as relevant pathways of impact on the forest. Its guidance therefore deals with mitigation, not simply a general tax on obtaining a residential planning permission. [1]
Check recreation and air quality separately
The council's recreational framework uses a 6.2 km zone of influence, with different tariff bands within that area. The air-pollution assessment is not limited to the same recreation boundary: development generating additional traffic elsewhere in the district may also require consideration. Ask the case officer which parts of the strategy apply to the actual proposal. [1]
The council's published approach concerns net additional dwellings, including those arising through relevant prior-approval routes. A commercial-to-residential conversion therefore should not assume that the absence of a full planning application removes the SAC issue. [1]
For an initial review, provide a site location, the existing lawful use, the proposed use and a clear before-and-after dwelling count. Identify any earlier permission or mitigation already associated with the site so the officer can explain how it affects the current assessment.
How the payment is secured
Epping Forest uses Section 106 obligations to secure the relevant financial mitigation. Its 2026 process provides an SAC-only unilateral undertaking template and a different route where wider planning obligations are involved. The appropriate deed must match the case officer's requirements and the land interests involved. [3]
The council's completion guide asks for the planning reference, site and title details, relevant parties and the specified contribution information. A mortgage can affect who needs to join the undertaking. Arrange legal review before execution rather than submitting a document with missing owners, an incorrect site description or an assumed contribution figure. [4]
What to allow in the budget
Obtain a current written calculation separating recreation, air-quality mitigation, any applicable green-infrastructure requirement, indexation and legal costs. Confirm the current indexed amounts with the council rather than relying on older tariff figures on its general applicant page. [1][3]
Keep the signed deed, the calculation and the payment evidence with the permission. Also record when the payment or other mitigation must be delivered. The project's assessment must establish that the necessary mitigation is secured and effective; sending an arbitrary sum does not substitute for that process. [2][4]
CIL and BNG are separate questions
Epping Forest is consulting on an updated draft CIL schedule from 1 to 30 October 2026. Its website explains that CIL would operate alongside appropriate Section 106 obligations, not automatically replace them. Do not substitute the draft CIL rate for a SAC contribution. [5]
Likewise, BNG has its own exemptions and requirements. Establishing an exemption from BNG does not answer the Habitats Regulations assessment of effects on the SAC. These are separate assessments, using different legal tests. [6][2]
