Planning outside London: what changes when the London Plan doesn't apply

Outside Greater London, the London Plan is not the area's development plan and Mayoral CIL does not apply. In Epping Forest District, start with the district's adopted Local Plan, relevant neighbourhood policies and England's national planning framework, then check local application and environmental requirements.

Epping Forest District uses its own adopted Local Plan alongside relevant neighbourhood policies and England's national planning framework. A design assessed for a London borough therefore needs a fresh policy check before being reused here. [1][2][3][4]

What replaces the London policy layer?

The National Planning Policy Framework published on 17 August 2026 applies in England. Its introduction explains that decisions follow the development plan unless material considerations indicate otherwise, with national decision-making policies considered alongside it. Crossing the Greater London boundary changes the local policy documents, not this basic approach. [5][4]

Epping Forest's Local Plan covers 2011–2033. A made neighbourhood plan can also carry legal weight in decisions. Check whether there is one for the location and distinguish an adopted or made document from consultation material. Do not assume a London requirement applies simply because the property is close to London. [3][6][1]

Which charges change?

Mayoral CIL is a London charge. Its absence in Epping Forest does not mean that a development has no infrastructure or mitigation obligations. The district publishes procedures for Section 106 agreements and a separate undertaking template for Epping Forest Special Area of Conservation contributions. Those requirements need their own assessment. [2][7]

As checked on 2 October 2026, the district's revised CIL charging schedule is a draft, under consultation from 1 to 30 October 2026. It is not an adopted charging schedule. Do not add a proposed district rate to a current budget as an established charge, or assume a future CIL would replace every Section 106 obligation. [8]

Which documents and consultees change?

Use Epping Forest's validation guidance rather than a neighbouring borough's checklist. Its published guidance separates householder, minor and major submissions and links to local sustainability material. Agree which supporting documents match the particular proposal; a familiar drawing package is not necessarily the complete local submission. [9]

Drainage also has a different local route. Essex County Council acts as Lead Local Flood Authority and is the statutory surface-water drainage consultee for major applications. Its guidance explains what it expects to review. This is separate from demonstrating that the building itself complies with building regulations. [10][11]

What stays separate?

Some home alterations can still use permitted development rights. Epping Forest directs applicants seeking written confirmation of lawfulness to the Lawful Development Certificate procedure. A favourable planning position does not replace building regulations approval: the national guidance says a project may need both, and identifies council building control and registered building control approvers as the ordinary building-control options. [12][11]

A current application-route exception

From 15 June 2026, Epping Forest's designation under Section 62A allows qualifying major applications to be made directly to the Planning Inspectorate instead of the council. It does not transfer every application: the council's FAQ confirms that householder and other non-major applications remain with Epping Forest. Check the route against the actual proposal, rather than assuming the designation changes the rules for a domestic extension. [13][14]
