Local plan
Local Plan Part 1: Shaping the Borough 2020–2035 was adopted on 29 February 2024, replacing the Core Strategy, Development Management Policies and the Walthamstow Town Centre and Blackhorse Lane area action plans. [1][2][3]
For home projects, read Policies 20 (HMOs and conversions), 53 (design), 56–57 (space and amenity), 72–73 (conservation and archaeology) and 91 (flood risk); Policy 20's conversion criteria include an original gross internal floor area greater than 124 m² and at least one 74 m² family home with three or more bedrooms, alongside its other tests. [3]
Also check the Highams Park Neighbourhood Plan, adopted on 21 May 2020 and amended in September 2025, and retained LLDC policy where relevant. [7][9][10][11]
Local Plan Part 2 received its Inspector's Report on 18 March 2026, but the council describes its post-examination text as information-only; obtain the formal adoption record before treating it as adopted policy. [5][6]
Council guidanceHouseholder design guide
Use the Residential Alterations and Retrofit SPD, adopted on 11 June 2026, which replaces the 2010 Residential Extensions and Alterations SPD. [14][13]
The council’s online section 7.6.2 sets first-floor rear-extension depths of up to 2 m for terraces and semis, or 3 m for detached homes, together with a 45-degree test measured in plan from the middle of the nearest habitable-room window on a neighbour’s original rear wall. [20]
Sections 7.9.11–7.9.13 distinguish dormers that should be inset by at least 0.25 m from ridge and eaves and 0.5 m from roof sides, where permission is required, from conservation-area rear dormers that must meet those setbacks. [23]
These are local design criteria, not a substitute for checking permitted development, and the SPD’s distinction between mandatory and advisory wording matters. [18][20][23]
Council guidanceValidation list
Use the 2025 validation checklists and the list for your application type: the council says applications missing the newly required information will be made invalid after 1 January 2026. [25]
The householder list requires the relevant drawings and site-specific supporting evidence, including a Planning Fire Safety Strategy or a Reasonable Exception Statement, rather than a blanket householder exemption from fire information. [27][26]
Basement construction, extension or deepening triggers a Basement Impact Assessment, with structural, groundwater, drainage and other relevant assessments coordinated for the proposal. [26][27]
Proposals creating one or more new homes, including prior-approval schemes, must also address the council’s Epping Forest Special Area of Conservation assessment and mitigation requirements; do not assume the standard householder checklist covers a conversion into flats. [29][28]
Council guidanceArticle 4 directions
The borough-wide C3-to-C4 HMO Article 4 direction took effect on 16 September 2014; check the signed instrument and mapped coverage rather than borrowing an LLDC exclusion from another borough. [32][33][34]
The separate Class MA commercial-to-residential direction took effect in its modified form on 29 June 2023 and covers only the land in its four incorporated maps, not every Class E property in Waltham Forest. [35][36]
Conservation-related directions and the Highams Estate direction, effective from 2 September 2020, remove specified rights in their own scheduled areas; Highams’ confirmed direction expressly excludes the originally proposed solar-PV restriction. [37][47][48]
Check the particular address, affected elevation or frontage and development class against the relevant order, not merely the conservation-area name or a general statement that all rights have gone. [31][40][43][48]
Council guidanceConservation areas
The council identifies 15 conservation areas and provides their individual appraisals and management plans; the Highams Estate Area of Special Character is separate, not an additional conservation area. [37]
Use the relevant area document alongside Local Plan Policy 72 and the 2026 SPD when designing extensions, roof changes, replacement windows or changes to front gardens. [3][13][49][50]
The Lloyd Park appraisal explains the distinctive Warner housing, including purpose-built flats, so a house-like exterior should not be taken as evidence that a property is a single dwellinghouse. [51]
Conservation-area boundaries, the neighbourhood-plan boundary and Article 4 schedules are different checks, and the council says the Leyton Town Centre appraisal and management plan is still being prepared. [37][9][48]
Council guidanceBasement policy
The council’s online 2026 SPD guidance, section 7.10.2, says basement additions and extensions are generally unacceptable, with possible consideration only in exceptional circumstances involving exemplar design outside areas at risk of flooding. [24]
The validation list requires a Basement Impact Assessment for basement construction, extension or deepening, while the flood authority’s guidance requires groundwater evidence for below-ground habitable accommodation and says such development is not acceptable in high-flood-risk areas. [26][27][52]
Where a basement abuts the public highway, section 7.10.4 requires an Approval in Principle document to be approved by condition before construction, with the applicant funding external review. [24]
For front lightwells, section 7.10.7 says at least 50% of the existing front garden should be retained; heritage, amenity and site-specific flood constraints still need to be addressed. [24][3][52]
Council guidanceCIL rates
For CIL-liable permissions granted in 2026 under Waltham Forest's borough schedule, the indexed residential rates are £108.79/m² in Zone A, north of the North Circular, and £117.15/m² in Zone B, south of it. [56]
The separate 2026 Mayoral CIL2 Band 2 rate is £72.73/m², subject to the charging provisions. [57]
The borough charging map excludes the former LLDC area, where the transfer scheme preserves the relevant LLDC schedules until withdrawal or replacement; obtain that area's applicable indexed local rate rather than applying Zone B to it. [56][12]
Check the mapped schedule, chargeable floorspace and any relief or exemption before starting work; an apparent entitlement to relief is not a substitute for the required claim. [58][59]
Council guidancePre-application advice
The published householder advice fee is £335 including VAT, covering either a formal written response, which can take up to eight weeks, or a 20-minute online appointment with an emailed summary. [60]
That service excludes changes of use, flat conversions and HMOs, and does not establish that work is permitted development. [60]
The separate small/medium service lists £1,681 for 1–3 units and £2,396 for 4–9 units, including VAT, with flat conversions within its scope. [61]
Use the correct online service and supply the plans and photographs requested, or contact planningvalidation@walthamforest.gov.uk about the small/medium route; check additional services and charges for the particular proposal. [60][61]
Council guidanceBuilding control
Contact Waltham Forest Building Control at building.control@walthamforest.gov.uk or 020 8496 3000; its postal address is Waltham Forest Town Hall, Forest Road, Walthamstow, London E17 4JF. [63][66]
Submit a building-regulations application through PlaceHub, which requires its own account rather than the council's My Account login. [64]
The council links a tariff dated 1 April 2023, so obtain a project-specific current charge quotation. [63][65]
Its current inspection notice says physical visits for small domestic projects are temporarily reduced and photographs or video may be accepted case by case: give advance notice and agree inspection arrangements with the service. [66]
