Record the symptom and assess the risk
Keep dated photographs, the location, when the problem first appeared and any changes. Describe the observation without assuming its cause: a stain, crack or movement can require technical investigation. RICS’s defects guidance addresses assessing defects and the evidence needed to understand them. [3]
For a possible immediate danger, obtain urgent assistance from an appropriately competent professional and restrict access as advised. Where emergency protection is needed, document what was done and why. Preserve removed material or other evidence where the investigating professional considers it useful and safe.
Notify the right people
Check the building contract, defects procedure and any relevant product or structural warranty. Notify the contractor and relevant insurer or warranty provider using the required method. NHBC’s published terms illustrate that insured cover concerns defined events and parts of the building, not every maintenance or workmanship issue. [4]
Ask for a written investigation and proposed remedy, and keep a record of access offered. Where consumer law applies, repeat performance and price-reduction rights have specific conditions; they should be considered alongside the contract rather than replaced by an informal promise of a future visit. [5] [6]
Do not confuse the defects period with claim deadlines
A contractual rectification period governs a particular return-and-repair process. JCT explains that liability for later-discovered defects can survive its end and the making-good certificate. The expiry of that period does not by itself answer whether a claim remains available. [1]
For England, the Building Safety Act changed limitation periods for specified Defective Premises Act claims. Section 1 claims have a 30-year retrospective period for work completed before 28 June 2022 and a 15-year period for work completed from that date. The new section 2A duty concerning work to existing dwellings applies prospectively to work completed on or after 28 June 2022, with a 15-year period. [7] [2]
These are not universal warranties for every cosmetic defect. The statutory duties concern fitness for habitation and have their own scope and legal tests. Do not assume an ordinary snag qualifies, or that every historic refurbishment has a 30-year claim period. [2]
Decide the next step on evidence
Assemble the contract, final drawings, completion documents, correspondence, photographs and expert findings. Ask the adviser to identify the appropriate respondent, remedy and deadline before commissioning substantial replacement work or signing a settlement. Obtain legal advice promptly where responsibility is disputed or a time limit may be approaching.
